1. Introduction
Welcome to WinMe, a platform owned and maintained by Refcoins (Pvt) Ltd. (hereinafter referred to as "Company," "we," "our," or "us"). By accessing or using our online platform ("WinMe"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use WinMe.
2. Definitions
Lead: Verified information and related data received through communications made using WinMe regarding a product or service, seller of a product or service, or information on a party interested in purchasing a good or service or the interest of a party to purchase a good or service.
Registered Merchant: A vendor of goods or services registered to offer their goods and services to Registered Users of WinMe.
Registered User: Any individual or entity accessing or using WinMe to obtain services offered by WinMe.
WinMe: The website, application, or any other online service provided by Company to facilitate the Users to find the best Leads for their purchases.
3. Eligibility to Use WinMe
To use the service offered by WinMe, you must either be a Registered Merchant or a Registered User.
4. Account Registration
- To access the services offered by WinMe you must create an account either as a Registered Merchant or a Registered User. You could be both a Registered Merchant and a Registered User
- You must provide accurate and complete information during registration and keep it updated.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
- The access to WinMe account can be suspended or terminated by Winme ,in terms of the agreement you entered at the time of registering with WinMe
5. Use of the WinMe
- Users agree to use WinMe solely for legitimate purposes and in compliance with applicable laws.
You must not:
- Offer or Request goods or services which are prohibited in law.
- Use WinMe to distribute spam, fraudulent content, or unauthorized communications.
- Interfere with or disrupt the operation of WinMe.
- Reverse-engineer, modify, or create derivative works from WinMe.
- Comply with all provisions of the agreement you entered into with us when you register with WinMe.
- If you are not a Registered User or a Registered Merchant, you are only permitted to view the public content on WinMe.
6. Lead Generation Services
- WinMe provides varified leads to both Registered User and the Registered Merchants through proprietary methods.
- WinMe does not guarantee the accuracy, completeness, or suitability of any leads provided.
- You are solely responsible for verifying the validity and appropriateness of the leads before using them.
7. Independence of the Transactions
- We are not a party to any contract you make on WinMe. After the initial lead receives through WinMe you shall directly negotiate and enter into an agreement with the counterparty. We do not represent or warranty any matter whatsoever with regard to your counterparty or your counterparty’s ability to perform the contract.
- You shall ensure you make use of all safeguards an ordinary person would have when entering into a similar contract.
- We are not taking any responsibility for the breach of contract by your counterparty.
8. Payment Terms
- Certain services may require payment. By using paid services, you agree to the pricing and payment terms displayed at the time of purchase.
- Payments are non-refundable unless otherwise specified.
- We reserve the right to suspend or terminate your access to WinMe if payments are not made on time.
9. Intellectual Property
- All content, features, and functionality on WinMe, including but not limited to text, graphics, logos, and software, are the intellectual property of WinMe or its licensors.
- You shall not copy, reproduce, distribute, or create derivative works from our intellectual property without express written permission.
10. Privacy
- Your use of WinMe is subject to our Privacy Policy, which explains how we collect, use, and protect your information.
- You shall read and understand our Privacy Policy before using WinMe. Your use of WinMe constitutes your consent to accept and abide by our Privacy Policy.
11. Disclaimers
- WinMe is provided on an "as is" and "as available" basis.
- WinMe makes no warranties or representations regarding the quality, reliability, or suitability of WinMe or any leads provided.
- We disclaim all liability for any direct, indirect, incidental, or consequential damages arising from the use or inability to use WinMe.
12. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claims arising under these Terms shall not exceed the amount you paid for the services during the one month preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless our Company, its affiliates, and its employees from and against any claims, liabilities, damages, and expenses arising from your use of WinMe or violation of these Terms.
14. Termination
We may suspend or terminate your access to WinMe at our discretion, with or without cause, and without notice. Upon termination, your right to use WinMe ceases immediately.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. The Parties agree to submit to the jurisdiction of the Courts of Sri Lanka.
16. Changes to the Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting on WinMe. Continued use of the Platform constitutes your acceptance of the revised Terms.
